SUMMARY:

This thesis aims to analyze the role of the Federal Court of Accounts (TCU) in land reform, particularly through Decision 775/2016-TCU-Plenary, which halted the policy conducted by the National Institute for Colonization and Agrarian Reform (INCRA) in 2016, which occurred during a historical moment marked by the impeachment of President Dilma Rousseff and the strengthening of sectors opposed to redistributive policies. According to the TCU at that time, there were nearly 600,000 settled workers who did not meet the criteria stipulated by law, justifying the suspension of policy actions. To understand the conditions that led to the emergence of this Decision in that context, an initial survey was conducted on the construction of definitions in laws and administrative regulations regarding the beneficiaries of land reform, as well as an analysis of the characteristics of the Federal Court of Accounts' actions. The study of the Decision revealed various legal disputes over the interpretation of laws between INCRA and the TCU, as well as other institutional actors. One of the repercussions of the Decision is the increased involvement of the TCU in defining the actions conducted by INCRA and its influence on the drafting of land reform laws and regulations since 2016, particularly concerning the definition of eligible beneficiaries. Finally, the thesis demonstrates that the increasing complexity of legislation for beneficiary selection developed since 2016 may impact the feasibility of implementing land redistribution policies, which are undergoing a lengthy process of dismantling.
