SUMMARY:

This study aims to analyze the emergence of the legal category of the special insured (segurado especial) and the process of constructing social security rights for rural workers classified under this category within the Brazilian Social Security system. The legal category of the special insured was created by Law No. 8,213/1991 to encompass rural workers who perform their activities without an employment relationship, either individually or under a family-based production regime, and who are currently situated within the context of family farming. The research takes into account the history of the social movements that supported the struggle for the construction of these social security rights. It presents the Brazilian constitutional framework, beginning with the country's first Constitution, and subsequently analyzes the infra-constitutional rules that established and regulated social security rights. Throughout this trajectory, social movements emerge as guiding elements in a pursuit of rights that developed belatedly when compared with the protection afforded to urban labor and the rights established within it. Rural social security is analyzed primarily from the perspective of citizenship, taking gender issues into account and highlighting the different conditions experienced by men and women in a context marked by the (in)visibility of rural labor in a country whose historical formation is deeply connected to the land, whether through the extraction of wealth or through agricultural and livestock activities. Following the establishment of equal treatment between rural and urban workers brought about by the 1988 Constitution, the study analyzes the rights then instituted and the historical and social context that enabled their construction. Finally, the research focuses on the difficulties faced by the special insured in proving the performance of rural activities, arising from their participation in labor relations that differ from those typical of urban settings and from the requirement to demonstrate this status in order to have their social security rights recognized.
