SUMMARY:

This research aims to analyze the overlaps generated by the Rio Branco law 2.040 of 1871, or free womb law for the municipality of Itaguahy in Rio de Janeiro in the 1870s. Through research with records of baptisms and deaths, post- mortem, wills as well as municipal council minutes from the 1860s and 1870s, we sought to examine the experiences generated by the free womb law in the region. Analyzing the debates prior to the law, as well as realizing the gender issues embedded in legislation in which the enslaved woman's womb is freed, but she does not gain her freedom. We are attentive to the meanings of maternity that could be experienced in this location, and understanding the uses of this legislation by the owners of enslaved people and by the enslaved people themselves. Thus, we can speak of asymmetrical power relations between these groups, in addition to the enslaved agency itself formulating its own strategies to build visions of individual freedoms.
