SUMMARY:
This dissertation proposes a comparative analysis of the organization of the judicial process in two legal sources produced by the Castilian-Leonese monarchy in the 13th century, the Fuero Juzgo and the Fuero Real. From this, the objective is to perceive the similarities and differences presented in the procedural structure and how they relate to the political project of the monarchs Fernando III and Alfonso X. Law underwent a renewal phase in Western Europe from the 11th and 12th centuries onwards, which resulted in the reinterpretation of classical sources and the specialization of jurists. Along with this, the judicial process also underwent important transformations, both in its structure and in its content, becoming more orderly. Although it started in the ecclesiastical field, as part of the Church reforms, this renewal did not take place outside secular society and was soon adopted by monarchies, as was the case of the kingdom of León and Castile. After the recent process of territorial reunification led by Fernando III and his expansionist policy, which was closely followed by his successor Afonso X, it was necessary to organize society in such a way that the maintenance of the kingdom and royal prerogatives were assured. One of the ways in which this happened was through the production of legislative codes, which would allow greater control of the monarchy in the resolution of internal disputes and in social life. Thus, we seek to analyze the procedural structure, starting from questions such as the role of the king, royal officials and other individuals involved, to understand the political project underway at that time.
