The present work aims to understand how was disputed and constructed the sense of those who opposed to the military dictatorship in Brazil. The years in which the military forces were in charge was marked by countless deaths and disappearances of the regime’s enemies. In 1979, through the Amnesty Law, those who opposed the military dictatorship were considered criminals, responsible for acts of violence. The establishment of the 1988 Federal Constitution changed the environment and transformed the so-called political criminals into affected, without any explanation about the deaths.
In the 1990s, with social pressure, arising from protests by family members and former political prisoners, a new legislation in relation to the theme emerged to recognize the deaths and disappearances during that period, and also identification of the condition of the people granted political amnesty. Through the National Truth Commission, a new environment was possible, with the recognition of the victims. In the face of what was exposed, it is possible to observe that, throughout this period, those who suffered violations of law during the military dictatorship were treated ambiguously. In this sense, the purpose of this thesis is to analyse the transformations around the construction of this category in the state and how the incorporation of new people took place from different criteria, since 1979, with the establishment of the Amnesty Law, followed by the political actions of governments in the 1990s and 2000s focused on the reparation of the affected by it and their families, until the year 2014, when the CNV released results of their work with emphasis on the victims. Therefore, it relates to the perception of those that suffered from violations and become an issue inside of the state.
