RESUMO:

Law 10.639 / 2003 is still at an insertion stage in the field of education, even though it has completed just over 15 years since its enactment. It is a slow process, with difficulties in its implementation in the school routine. And this difficulty encompasses a number of social, political, and cultural issues, built throughout the process of colonization and formation of Brazilian society that continues to this day. However, the law has received attention in several respects because it has become a legitimate instrument for combating various forms of racial prejudice and discrimination. From this perspective and the possibilities of work that Law 10.639 can provide, here, more specifically, I raise a question regarding the construction of the identities of black children in the initial years that reside in the periphery / favela and study in a school located in the same space . The Haydéa Municipal School Vianna Fiúza de Castro, located in the municipality of Rio de Janeiro, in the neighborhood of Santa Cruz, in a town called Vila Paciência, better known as Favela do Aço. How has Law 10.639 / 2003 contributed to the process of visibility, (re) knowledge and construction of the identities of black children? The research proposes, in the first moment, to take a look at the perspective of research, Racial Relations, what is dealt with Law 10.639 / 2003 and its relevance to the educational field; therefore to speak about Black Identities and the importance of their constructions to be initiated in early childhood. And, starting from this context and the concepts that will be approached, the second moment will be worth bringing the field of research and methodology, based on Oral History, where we will try to conduct semi structured interviews with black children. These children, who are considered research subjects. During the course, the methodological process will take into account the existence of pedagogical and human resources, which treat and converge with the exercise of Law 10.639 / 2003. It starts from the premise that it is necessary to advance and make ever more broad the discussion of what it is to be a black and black subject in Brazilian society and in what has been the constructions of black identities, since early childhood in post-law 10,639 .
