The purpose of this research is to analyze the right and access to daycare vacancies in the Baixada Fluminense. The right of children to daycare was established as a public policy in the 1988 Constitution and reinforced in LDB 9394/96, which considered Child Education as the first stage of basic education, with daycare being the segment aimed at babies and children up to 3 years of age. However, more than twenty-five years after the promulgation of this right, in 2022, daycare services have not materialized as a right for the large Brazilian population. Faced with a supply that is much smaller than the demand, many arrangements are made in the context of the education departments. The theoretical framework of this research is built on the interconnection between education, sociology of organizations, and public policy analysis. The access to daycare vacancies, as well as other educational policies, takes place in an arena of disputes. In this sense, the proposed research focuses on the norms and strategies of the networks in defining the distribution of vacancies, especially the role that the directors of the institutions take on the implementation of this policy. In the theoretical framework adopted in the research, the directors work in the middle layer of the bureaucracy, being nominated as middle-ranking bureaucrats. The empirical field is the municipalities of Baixada Fluminense that accepted the challenge of attending children under one year of age in Early Childhood Education. Methodologically, this is a study of qualitative approach Marconi and Lakatos (2003 p. 269) which, through the analysis of documents, questionnaires to coordinators of Early Childhood Education teams of the secretaries of education and semi-structured interviews with directors of public daycare centers, intends to know the struggles, challenges and strategies used in the implementation of this policy.
