SUMMARY:

The scenario of violence, disclosure of heinous crimes committed involving adolescents/young people, puts into circulation in society the debate about reducing the age of criminal responsibility in Brazil. For a better understanding of such psychosocial phenomena, we will analyze the social representation of the age of criminal responsibility in Brazil and the measures applied. We will use Serge Moscovici's Theory of Social Representations and Jean-Claude Abric's Structural Approach in order to identify the central and peripheral core of such representations. The research will be of a qualitative nature, and for data collection we will use the task of free evocation of words, based on the inductive term “reduction of the age of criminal responsibility”, a questionnaire with structured questions guiding the SR around the research objects, reduction of criminal majority, socio-educational measures, infractions and socio-demographics, such as gender, age and education of 147 Brazilian subjects from different social groups.The analysis technique, Bardin's content analysis; for data processing, EVOC software, and Iramuteq, software from the R statistical package, used for content analysis, lexicometrics and discourse analysis. We verified polarized speeches about reducing the age of criminal responsibility in Brazil: when they mentioned that teenagers who commit criminal acts would need stricter and more punitive laws, they defended the age for criminal liability as 18 and 16 years old in the majority, and 14 or younger in its minority; and on the socio-educational measures applied, for those who committed infractions considered serious, they were punished equally to adults, in this case, imprisonment, as they had discernment of their acts, in addition to more job opportunities, full-time schools, professional courses in socio-educational units and prison systems; and about what leads teenagers to commit infractions, lack of punishment, absence from family, lack of education, absence of the State to discipline them; otherwise, the speeches produced were that criminal non-imputability does not mean impunity, that reducing the age of criminal responsibility will not be able to resolve the issue of delinquency committed by these social actors; maintain the age of 18 for criminal liability; and that socio-educational measures need to be reviewed, as in practice they are more punitive than socio-educational, they reinforce the stigma of delinquency and are not applied fairly to all social classes, thus, adolescence for those living in poverty, those black people, those who live on the outskirts, mainly in large urban centers, are criminalized; and what leads adolescents to commit criminal acts is emotional abandonment, among other causes, such as the lack of compliance with the fundamental rights of children and adolescents, effective public politics. The social representations of the age of criminal responsibility in Brazil, in addition to contributing to our reflections on issues of violence, bring us to light on how Brazilian society socially represents adolescents in conflict with the law, gives us a historical overview of poor and others in vulnerable situations, as well as social innovations aimed at children and adolescents over the years, from the period before the Minors Code to the current one in order to guarantee their rights as citizens.
