SUMMARY:
This work aims to study the implementation of South Korea's National Security Act, which was enacted in 1948 and maintained, although with several modifications, until the time this dissertation is being written. From the analysis of the context of the formation of Korean political and intellectual thinking that was established from the late Nineteenth century and the events that led to the division of the peninsula, we intend to demonstrate how this law gave legal basis to persecution of leftist political entities in the years of the First Korean Republic (1948-1960) and also during the military regime period (1961-1987). After the fall of the latter, some parts were attenuated in that law, which gradually allowed the existance of new parties linked to the left of the political spectrum. However, the practical application of this legal instrument continued to be used against left-wing organizations, called in that country as “Progressives”, as they remain as targets of suspicions and accusations that they might be spying for the communist counterpart, North Korea, or even taking action to establish Communism in the southern portion of the peninsula. Therefore, we seek to use the main object -and its applications- to better understand the Korean political reality throughout all regimes established from 1948 to 2014, especially in dealing with left-wing political parties in the period.
