SUMMARY:

The present work proposes to comparatively analyze the procedural aspects of two legal sources established in the Castilian-Leonese kingdom in the thirteenth century: the Fuero Juzgo and the Fuero Real. The main goal is to identify similarities and differences that allow us to analyze how the law was instrumentalized by the monarchy, as a tool for the affirmation of royal authority.

After the territorial and political unification, as well as the growing expansion derived from the wars with the Moors, it was necessary to maintain what had been conquered until then, being essential to reinforce the monarchical power internally and externally. In this purpose, Fernando III and Afonso X bet on legal organization as a mean of social ordering, encouraging the translation and production of legal codes with a general nature and wide validity, which legitimized the king's position as responsible for the justice and peace of the kingdom.

To develop our work, we will use books I and II of Fuero Juzgo and Fuero Real, starting from three variables of comparison: 1) Who are the royal employees that are part of the judicial process and what are their functions; 2) What is the role of the king in the judicial process; 3) Which individuals may or may not have a role in a case (as witnesses or in other roles). From then, we will seek to reflect whether or not there were changes in the procedural aspect from one source to the other and how this relates to the political project of affirmation of royal power.
